A qualified Adjudicator under the Institution of Civil Engineers training and accreditation scheme, James Torr, has acted in disputes involving Consulting Engineers, Contractors, Subcontractors, Sub Subcontractors and Employers.

Adjudication procedures followed have included the Government Scheme, the JCT Building Contract Procedure and the ICE Adjudication Procedure

Expert Determination

Expert Determination is found in commercial contracts of all kinds and is often chosen as a private system offering distinct savings of time, cost and complexity.

The process has not been widely practised in the Construction Industry but Insurers are currently increasingly turning to Expert Determination to apportion responsibility between defendants in an action where the parties have accepted liability to the Claimant.

Litigation Support Services

Expert services are provided in compliance with the new Civil Procedure Rules (1999)

Expert Witness services are rendered in accordance with the Code of Conduct and Conditions of Engagement of the Academy of Experts. Fees are computed on a time basis with hours being recorded against tasks to facilitate Taxation. Fee levels are controlled by the use of technical assistants where appropriate.

James Torr has acted as Expert Witness in cases involving accidents, failures, collapses, faults and subsidence, contractual disputes and professional negligence. Evidence has been given, since 1980, in the High Court, County Courts and the Official Referees Courts, now the Technology and Construction Courts, and in Arbitration.

Planning Supervision Services

The Planning Supervisor is a creature of the Construction (Design and Management) Regulations 1994, which came into force in 1995.

The duties of the Planning Supervisor involve ensuring that the HSE is notified of a construction project, designers co-operate in health and safety issues; a pre-tender Health and Safety Plan is prepared and that the Health and Safety File is developed.

James Torr is a trained and accredited Planning Supervisor and has been a Member of the Association of Planning Supervisors since 1995. He first carried out the role in 1994, prior to the introduction of the Regulations, participating in a pilot scheme administered by the London Dockland Development Corporation.
