Party
Wall matters & Neighbourly work |

The
Party Wall etc Act 1996 which came in to force in 1997 covers England
and Wales, and imposes duties on building owners wishing to carry
out works on or close to party walls to protect both them and the
adjoining owners.
Arthurell and Kirkland have considerable experience in both residential
and commercial situations, and have been involved in a wide variety
of Party Wall cases including appointments from both building and
adjoining owners.
We can advise clients on the implications of their projects under
The Act and of their rights and obligations. Where necessary we will
serve the relevant Party Wall notices, prepare and agree condition
schedules, and negotiate an Award for the building works to progress
without delays.
We also advise and negotiate on Neighbourly issues associated with
building developments, acting either on behalf of the developer or
the neighbouring owner affected by the works.

Planning
Supervisor |

The
Planning Supervisor role was created under the Construction (Design
& Management) Regulations 1994 (CDM) to monitor and improve Health
& Safety issues in building and construction works. They give the
Client a statutory responsibility to appoint a Planning Supervisor
to oversee all Health & Safety issues.
Melville Kirkland is a member of the Association of Project Safety.
Arthurell and Kirkland are qualified to carry out the full pre-contract
and post contract responsibilities of the Planning Supervisor as
required under the legislation.
