Disastrous IT implementations, where costs and timescales run out of control, are not unknown. But fewer implementations are now "first time" systems and more senior managers involved have gained in knowledge and confidence through experience in other projects. No longer the naive first time user, more are resorting to litigation when it all goes wrong.Major computer disasters make for dramatic headlines, yet when it comes to sorting out the mess matters are seldom black and white.
Whether budgets were too tight, deadlines too short or expectations too great, the chances are that the buyer is in some way responsible for the suppliers failings.
IT systems suppliers on the other hand have had it relatively easy for too long. Today's IT conscious customer is more likely to consider and draw up a Specification of Requirements and take some time to understand (and change) the suppliers contracts.
Estimates suggest that around 90% of serious contractual disputes are settled out of court, but the IT world is also changing and is increasingly more likely to argue its case in court.
Set up originally to focus upon new systems selection and implementation our typical assignments have now extended to include strategic reviews for further systems development and assisting clients in reviewing and improving existing systems.
Having guided clients through many successful systems implementations we are extremely well placed to perform investigative work for users or suppliers where problems have been encountered and disputes have progressed to a stage of involving lawyers. We would hope to assist in settling disputes before they end up in court but should court proceedings be instituted, we can be retained in the capacity of an expert witness. We could then not only advise clients, solicitors and/or Counsel, give written opinion and testify in Court, but could also assess the evidence of the other side. We could therefore assist in the cost saving process of achieving a fair settlement of the proceedings, or failing this, give expert witness and support to the clients and their legal advisers which would hopefully result in a successful outcome.
