Dispute Resolution The advantages to all
parties of resolving disputes without recourse to litigation are widely
acknowledged. The early intervention and advice of an independent expert can
assist in promoting negotiated settlements. Our advice has contributed to the
settlement of many actions out-of-court, and we are always pleased to assist
in such endeavours, whether in pre-action negotiations or as the matter
proceeds through the Courts, Arbitration, Adjudication,
Mediation or some other form of ADR. Where cases are concerned
with technical issues alone, Expert Determination can provide a confidential,
fast and cost-effective means of resolving disputes.
It is a private process in which an agreed expert in the subject matter is accorded inquisitorial powers, and the parties agree to
be bound by his decision. Our familiarity with the
roles and responsibilities of the contracting parties and their advisors in
engineering contracts enables us to assist as technical advisors during the
preparation of the technical case on a party-appointed basis. As experienced consulting
engineers, we are accustomed to acting fairly between client and contractor
and are ready to apply our experience and diplomatic skills to assist as
technical assessors, or as independent assistants to a Tribunal or
Adjudicator. We are ready to assist
with the detailed analysis needed in formulation of the Letters of Claim and
in preparation for the pre-action meetings of parties. When called upon to prepare or assist in preparation of any documents in connection with resolution of a dispute, we recognize the importance of strict compliance with any timetables agreed with instructing solicitors, to facilitate adherence to applicable time limits. |
