Sheriff Officers and Messengers-at-Arms
Scottish civil law designates the responsibility of process service and enforcement to Officers of the Court, known more specifically as Sheriff Officers and Messengers-at-Arms. Individual officers are given commissions relating to the jurisdictions (areas) in which that officer may operate, and so it is very important to ensure any Officer of the Court you instruct has the correct commission. The commissions of Llewellyn and Company are listed on the left hand side of this page, however if you are unsure of which area your service falls under feel free to contact us for further information.
Please note that the titles of Sheriff Officers and Messengers-at-Arms are soon to converge to form the combined “Judicial Officer” role. Since the two roles are found together in Llewellyn and Company this will not greatly effect our services, other than bringing them into line with the impending “Bankruptcy and Diligence etc (Scotland)” Bill.
- Produce documents for service where granted by the courts, using our extensive case management system to maintain a high standard of accuracy at all times in the process. Including but not limited to: Charges, Arrestments, Evictions, Family Actions, and Summonses.
- Serve execution and provide citation for civil court orders in Scotland.
- Serve Scottish actions in the entire United Kingdom and vice-versa, where granted by the courts.
Sheriff Officers are not allowed to differentiate on the price of service as this is fixed by the Act of Serudent; however we believe that our efficiency and accuracy will prove the quality and value of our service beyond a doubt.
